Guidance After the Loss of a Loved One
Settling an estate can bring unfamiliar responsibilities during a difficult time. Finding documents, identifying property, communicating with beneficiaries, and understanding who has authority to act can feel overwhelming.
Joshua Harden at Memento Mori Law helps personal representatives and families navigate probate and estate administration in Kansas and Missouri. Based in Shawnee, Kansas, the firm offers web consultations to make the initial conversation easier to arrange.
Start With Authority and Information
An important first step is determining who is authorized to administer the estate and what process applies. A family relationship alone does not resolve those questions. A will, trust, ownership arrangement, or court appointment may affect who can act and how particular assets are handled.
Josh can review the available information and help identify the next steps. Bring any will or trust, death certificate, court papers, and a preliminary list of assets and debts. You do not need every answer before making the first call.
What We Can Discuss
-
Whether probate is needed for the property involved.
-
The role and responsibilities of a personal representative.
-
Locating and organizing estate documents and records.

Questions about assets, debts, beneficiaries, and distributions.

Coordinating probate property with assets that may pass through other arrangements.
-
Understanding the legal steps needed to conclude administration.
Take Care Before Making Distributions
Transferring property or paying expenses without understanding authority and obligations can complicate administration. A review of the estate's circumstances can help establish priorities and identify issues that require attention before distributions are made.
Josh's experience of losing both parents informs his appreciation for the uncertainty families can face. The legal work focuses on giving the person responsible for administration a clearer understanding of the process and their duties.
Common Questions
Does every estate need probate?
Not always. Ownership and beneficiary designations matter. Kansas permits an affidavit to transfer qualifying personal property when probate assets total $75,000 or less (K.S.A. 59-1507b). Missouri has a court-filed small-estate procedure for estates of $40,000 or less after liens, debts and encumbrances, generally after 30 days (RSMo 473.097). Other requirements apply; Josh can review which process fits.
How long will administration take?
Timing varies. The property involved, creditor issues, disputes, court procedures, and other circumstances can affect the process. Josh can discuss the factors relevant to the estate rather than promising a universal timeline.
Can I start with a web consultation?
Yes. A remote consultation can help you organize the initial questions and determine the scope of assistance needed. Court and document requirements are considered separately.
